Terms and Conditions of Sale

NOOSA alive! ABN 50 175 875 841 (“Noosa Long Weekend”) provides events and ticketing services, including the sale and distribution of tickets, as the seller, from time to time the agent for the venue, promoter or person responsible for holding the relevant event. In providing these services, NOOSA alive! owns and operates noosaalive.com.au (the “Site”).
Please read these Terms and Conditions carefully before purchasing a ticket. By purchasing a ticket from NOOSA alive!, you agree to be bound by these Terms and Conditions.

These Terms and Conditions relate both to the sale of tickets and attendance at events. These Terms and Conditions apply to both the original purchaser and any subsequent ticketholders (“you”).

NOOSA alive! may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.

Each ticket is also sold subject to any additional terms and conditions of the Seller for the particular event (including their Conditions of Entry) (“Seller’s Terms”). The Seller’s Terms may be disclosed as part of the event information on NOOSA alive!’s website and at NOOSA alive! events and outlets at the time of purchase. The Seller’s Terms are also available from NOOSA alive! on request.
NOOSA alive! acts as the Seller and at times an agent for the Seller in the sale of all tickets. As such, except as specified in these Terms and Conditions, all claims in connection with tickets or events are the sole responsibility of the Seller and, except to the extent required by law (including the Australian Consumer Law) NOOSA alive! otherwise has no liability to you.
Without limiting other remedies, NOOSA alive! may limit, suspend or terminate the account of users who are acting inconsistently with these Terms and Conditions, including in particular the accounts of users who we believe are harassing, threatening or abusing our employees or other users or who act in an unlawful or inappropriate manner. For clarity, NOOSA alive! may limit, suspend or terminate the account of a user which has been activated primarily to circumvent temporary or permanent suspensions already in place with respect to a different account.

Unless otherwise provided under the Refundable Tickets Terms and Conditions of Sale (if applicable):

  1. NOOSA alive! does not offer refunds or exchanges as a result of a change in your personal circumstances or due to external factors such as, for example, adverse weather. NOOSA alive! will only provide a refund or exchange a ticket if an event is cancelled, rescheduled or significantly relocated by the Seller (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law (including the Australian Consumer Law). If an event is cancelled, you do not need to apply for a refund as we will automatically attempt to process a refund back to the original payment method used to purchase the ticket. Otherwise, you must apply for a refund by the earlier of: (a) 4 weeks after notification of the reschedule or relocation; or (b) 72 hours prior to the event. If you do not request a refund by that date, you will have agreed to the reschedule or relocation and will not be entitled to claim a refund;
  2. If an event is cancelled, rescheduled or significantly relocated by the Seller, all liability is limited to the amount for which the ticket was purchased (including any fees or charges unless otherwise notified at time of purchase). Proof of purchase may be required for any refund or exchange. Unless required by law (including the Australian Consumer Law), neither NOOSA alive! nor the Seller will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses;
  3. NOOSA alive! will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. NOOSA alive! may charge a reasonable fee for the replacement of tickets. NOOSA alive! may not replace tickets where seating is unallocated (general admission tickets);
  4. You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling or relocation;

If a variations to a performances or event occurs:

  1. The Seller reserves the right to add, withdraw, reschedule or substitute artists, performers, teams or players and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.

Conditions of entry

Admission to an event is subject to the Seller’s Terms.  In particular, the following forms part of the Seller’s terms unless otherwise specified:

  1. You may be denied entry into, or removed from, an event where the Seller has reasonable grounds to do so, including if you breach these Terms and Conditions or the Seller’s Terms, or you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others.
  2. If you arrive late, you may not be admitted until a suitable break in the event.
  3. You may not be permitted to take into the event, or use, cameras or other photographic or recording equipment (including mobile phones).
  4. You may be required to submit to a search of your person and/or possessions before entering the event.
  5. By attending the event, you and each attendee in your group acknowledge and agree that you each may be filmed and/or recorded and you each give permission to the Seller and NOOSA alive! to use your image, likeness and voice obtained at the event in all media throughout the world for any purpose and without any compensation.
  6. You agree to comply with all Government directions, orders and regulations relevant to attending live events, which may be in place at the time of the event.
  7. You are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government, including the Department of Health for the purposes of contact tracing, you must: (a) make the contact details of your group available to the Government (if you have the consent of each group member to do so); or (b) contact each member of your group, and request that they provide their contact details to the Government directly.
  8. When attending the event, you and each attendee in your group agree to assume all risks associated with COVID-19 or other such communicable diseases.

Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from NOOSA alive! or other authorised points of sale.

Tickets may not, without the prior written consent of NOOSA alive! and the Seller, be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder of the ticket may be refused admission. NOOSA alive! will use reasonable efforts to notify you of such action.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

You must allow adequate time for collection or delivery of tickets. Methods of collection and/or delivery will be available when choosing your collection/delivery details. In the interests of minimising ticket scalping, NOOSA alive! may change your delivery method to “venue collect” at its discretion.

Where concessions are applicable, suitable and valid identification must be provided for collection of tickets and at the event.
When purchasing tickets for a particular event you may be limited to a specified number of tickets. If you exceed the stated ticket limit, you may have any or all of your orders and tickets cancelled without notice by NOOSA alive! at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets for fans, and as a measure to minimise ticket scalping.

Errors

While NOOSA alive! takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. NOOSA alive! may cancel an order made as a result of any such error, although in the case of a pricing error NOOSA alive! will endeavour to contact you to give you the option of purchasing the ticket at the correct price.
If an error on your behalf results in NOOSA alive! reprocessing the ticket transaction at your request, NOOSA alive! may charge to you the actual costs incurred in reprocessing the ticket transaction, including any chargeback or postage fees charged to NOOSA alive! by a third party.

We Respect Your Privacy

At NOOSA alive!* values the security of personal information that we collect.

Our aim is to provide information on how we handle and manage your personal information in an open and transparent manner, so that you can make informed decisions about your dealings with us. However, if you have any questions about this Privacy Policy or how we manage your personal information, please contact us.
We may update or revise this Privacy Policy from time to time. You can find the most current version on our website (www.noosaalive.com.au) or ask us for a copy.

Depending on our interatction with you, the personal information we collect will vary and may include:

  • your name, address and other contact details (like your telephone number);
  • your email address;
  • your date of birth;
  • your gender;
  • transaction details relating to any purchase(s) that you have made with us or that have been made on your behalf;
  • credit card details, if you make a purchase with us or choose to have these stored in your online NOOSA alive! account;
  • your NOOSA alive! username;
  • any preferences that you select;
  • any charities you prefer to support; and
  • any other personal information which may be required in order to facilitate your dealings with us.

We collect personal information when you:

  • make a purchase through our ticketing system which includes our website, mobile site, calling to book direct or group bookings;
  • register as a NOOSA alive! member via our website or mobile site;
  • participate in a NOOSA alive! survey, competition, promotion or other marketing campaign;
  • indicate that you wish to subscribe to our news, earlybird offers, sponsor offers or other marketing material from NOOSA alive!;
  • sign up to a waitlist or an event
  • make an inquiry or a complaint;
  • have other dealings with us, for example, via email, social media or in person, over the phone or when you write to us.

In certain circumstances we apply for grants to support the festival beyond our 20+ year history. We may also collect personal information about you in the course of combining and analysing different data sets which, in and of themselves, may not contain personal information.

Sometimes we collect personal information about you from other sources, for example:

  • people making a purchase on your behalf;
  • our business clients such as venues, charities, promoters and sporting clubs; or
  • third party suppliers and contractors who assist us to operate our business, such as:
    • information technology suppliers, Government tourism bodies
    • marketing and digital services suppliers ie surveys
    • research and development organisations
    • data partners
    • analytics consultants; and
    • publicly available sources of information

Also, from time to time NOOSA alive! collects personal information about individuals who are not customers. This is usually where we collect the name and business contact details of a person who is the contact in a government agency or company with whom we deal. NOOSA alive!’s policy is to only use personal information collected from non-customers for the main business purpose for which it was collected.

NOOSA alive! may hold your personal information in electronic or hard copy format or a combination of both. This personal information may be combined or linked with other information held about, or which we attribute to, you, including:

  • information (personal or otherwise) that we collect from our website and mobile site (as described below in relation to “Cookies, Tracking and Advertising”) or from third parties; and
  • personal information we receive from our group companies and client businesses, who, in common with us, have a relationship with you and where we understand that you have consented to such group companies and client businesses sharing your personal information with us to bring you quality events at affordable prices.

We have taken a number of physical, electronic and procedural steps to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

NOOSA alive! protects the personal information it collects in a secure database stored by our third party data storage provider.

NOOSA alive! also employs firewalls, intrusion detection systems and virus scanning tools to protect against unauthorised persons and viruses from entering our systems.

NOOSA alive! employees are required, as a condition of their employment, to treat personal information held by NOOSA alive! as confidential, and to maintain the confidentiality of that personal information. They are also required sign in and use a password when accessing NOOSA alive! systems and to undertake training about how to manage personal information.

Generally, NOOSA alive! only uses personal information for the primary purpose for which we have collected it, or for another closely related secondary purpose. Our potential uses of personal information which NOOSA alive! collects (and for which you consent to us using your personal information for) may include:

  • to process and fulfil your orders for tickets (or other items) from us;
  • to contact you if there is an event cancellation or change in event details, or for the replacement of lost tickets;
  • to get a better understanding of you, your needs, your behaviours and how you interact with us in order to identify ways in which we
  • can provide you with a better service, or enhance your experience of our website and mobile site or other services;
  • managing your dealings with us as a NOOSA alive! attendee;
  • so that we can promote our products and services to you and the products and services of third parties that we deal with;
  • from time to time, allow our related companies to promote their products and services to you and those of their partners;
  • so that venue operators and promoters of events for which you purchase tickets sponsors, sporting clubs, authorised ticket onsellers
  • and resellers can use it for operational purposes;
  • detecting and preventing fraud and unauthorised ticket onselling;
  • for business research and development of new products and services, including for NOOSA alive! attendees and our business clients;
  • to facilitate the charity, competitions, special offers and promotions that we or our partners run;
  • displaying content and advertising (including in relation to tickets and events and artists) that is customised to your interests, preferences and experiences, including through online targeted marketing, data and audience matching and market segmentation activities;
  • verifying your identity;
  • so that we can respond to inquiries and complaint handling; and
  • for the conduct of data analytics and predicting trends;
  • marketing services in connection with the products and services we provide; and
  • to comply with our legal and regulatory obligations and enforce our legal rights.

Sometimes NOOSA alive! will produce aggregated data. NOOSA alive! may also receive aggregated data from its third party suppliers and contractors or business customers. This aggregated data does not identify individuals. NOOSA alive! uses, and may combine, the aggregated data it produces and receives for research purposes and in connection with products and services we provide to our business clients.

From time to time, there may be other purposes for which we collect, hold, use and disclose your personal information. We will tell you about these at the point of collection.

In addition, the marketing communications that we send to you may also contain information on how to unsubscribe from those communications.

You can also tell us at any time if you do not want us to disclose your details to other organisations such as our related companies or third parties for marketing purposes. To do this, you just need to contact us.

NOOSA alive! may disclose your personal information:

  • to venue operators and to promoters of events for which you purchase tickets. NOOSA alive! discloses your personal information to such organisations for operational purposes and also because from time to time they may choose to provide you with information about their events by ordinary post. If you consent, these organisations may use this information to provide you with promotional and marketing material about their events via email. You may change your preference to receive email marketing at any time directly with the organisations which have obtained your information. If you do not have their details, you can contact us directly;
  • to sponsors, charities, sporting clubs, authorised ticket onsellers and resellers who (unless they obtain a separate consent from you) use it for operational purposes only, for example, to provide you with additional information about the event or venue that you are attending; and
  • to third party contractors and service providers who help us operate our business or provide a service to you. NOOSA alive! may disclose your personal information to third party contractors and service providers who, for example, help us with grants, operate our computer systems, provide us with fraud prevention services, send out our mail/email and clean collected data and who perform data analysis to group demographic attributes of individuals.
  • if applicable, to Government bodies/instrumentalities or the Seller, in response to, or in anticipation of, a request for your personal information for the purposes of COVID-19 contact tracing or responding to COVID-19 related public health orders or directions. The contact tracing information which may be disclosed includes your full name, contact email and/or contact phone number and by purchasing your ticket, you are providing NOOSA alive! with your permission to disclose such information for this purpose.

Otherwise, NOOSA alive! will only disclose your personal information:

  • where we are required to do so by law;
  • if the disclosure is permitted under the Privacy Act 1988 (Cth); or
  • if you have consented to the disclosure.

Some of the recipients to whom we disclose personal information may be located overseas, although the countries where such recipients are located are limited.

Where it is lawful and practicable to do so, we will give you the option of not providing personal information, or of using a pseudonym, when you deal with NOOSA alive!. For most events, you may be able to make a cash transaction at a NOOSA alive! event without providing personal information.

However, if we do not collect personal information about you at the point of sale or when you interact with us, this could impact the level of service we can provide to you, for example, we will not be able to contact you in the case of an event cancellation or venue change or we may not be able to properly respond to your inquiry or investigate your complaint or fully process your transaction.

For each visitor to our website and mobile site, our server automatically recognises and stores the visitor’s IP address. In addition, our website and mobile site use cookies. To enhance your experience when using our website or mobile site, these store information you have provided to us (such as your postcode, preferences, region and sign in username) to enable us to provide a more personalised service to you. Our website and mobile site may also carry third party cookies, which automatically collect anonymous information from you, such as your demographics and interests. This information may be disclosed to third parties for the purpose of providing you, and others, with a more targeted ticket and event information and/or an enhanced advertising experience both on and off the NOOSA alive! website or mobile site. Most web browsers are set by default to accept cookies. However, if you do not wish to receive any cookies you may either set your browser to prompt or refuse cookies. Note that rejecting cookies will disable your browser from purchasing tickets from our website or mobile site. We also use cookies for measuring, collecting, analysing and reporting data from our website and in connection with general marketing and research services. This allows us to better understand our users and improve the layout and functionality of our website.

Sometimes our website or mobile site contains links to third party websites, for your convenience and information. When you access a non-NOOSA alive! website, please understand that NOOSA alive! is not responsible for the privacy practices of that site. We suggest that you review the privacy policies of each site you visit.

To try and bring you offers that are of interest to you, NOOSA alive! has relationships with other companies that we allow to place advertisements on our web pages.

Under the Australian Privacy Principles, you have a right to request access to the personal information that NOOSA alive! holds about you and seek its correction. You may access or correct some of you information by logging onto our website (www.noosaalive.com.au). If you are not a My NOOSA alive! member, so that your request reaches the right person, please send it to us. Please include your contact details such as email address and telephone number and enclose a copy of a form of identification such as a current driver’s licence or passport. We will not charge you for making such a request but will let you know if there is a cost for supplying you with access to or correcting the personal information. We aim to respond to requests for access or correction within 30 days. There are certain situations under the Australian Privacy Principles where we may refuse to provide you with access to or correct your personal information but we will always let you know in writing if this is the case.

If you feel that NOOSA alive! is not complying with this Privacy Policy or the Australian Privacy Principles contained in the Privacy Act 1988 (Cth), please put your concerns in writing and send them to us by one of the methods set out above.

We will always endeavour to investigate your complaint and respond to you as soon as practicable after receipt, generally within 30 days. If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner.

REFUNDABLE TICKETS TERMS

We provide refunds if…

You are unable to Attend your Booking due to any of the reasons below and have provided the evidence requested below. Please also read the General Conditions of Refund.

  • Illness / Injury (including Covid-19)
  • Pre-existing Medical Condition
  • Pregnancy Complication
  • Death of Immediate Family
  • Public Transport Failure
  • Flight disruption
  • Mechanical Breakdown
  • Adverse Weather
  • Home Emergency
  • Theft of Documents
  • Jury Service
  • Court Summons
  • Armed Forces & Emergency Services Recall
  • Relocated for Work
  • Changes to Examination Dates

If Your Booking is cancelled or postponed by the organiser, You should contact Our standard Customer Service team directly via our Help Centre; see Your Booking confirmation or our website Help Centre for contact details.

We may consider other Emergency Circumstances at our discretion.

General Conditions of Refund

  • Any reason for refund must not have reasonably foreseeable at the time You made the Booking.
  • We do not refund if You made Your Booking by mistake, or it is no longer wanted or needed.
  • If Your Booking is cancelled or postponed and You can no longer Attend please contact the Customer Service team directly via our online Help Centre.
  • You must make all arrangements to arrive in time to Attend the Booking, including arranging any necessary travel or documents.
  • You will be asked to provide Your bank account details so that we can make the refund payment directly to Your chosen bank account.
  • Maximum refund value per person will not exceed the total value of their share of the Booking, or $20,000 AUD.

Covid-19…

We may refund where You are unable to Attend Your Booking because of one of the following reasons associated with Covid-19:

  1. You, or someone within your Immediate Household, become infected with Covid-19 within the 7 days immediately prior to Attending Your Booking, meaning you have to isolate or shield; supported either by evidence of a positive PCR test result or communication of isolation from your relevant government following a RAT test.
  2. Someone within your Immediate Household, becomes infected with Covid-19, meaning you have to isolate or shield according to the law of the appropriate national government, supported by evidence of positive PCR test or government communication of isolation.
  3. The hospitalisation, or death, of Your Immediate Family Member due to Covid-19, within the 30 days immediately prior to Attending Your Booking; supported by a medical / death certificate.
  4. A significant change in Your pre-existing medical condition in the 14 days immediately prior to Attending Your Booking results in a Doctor recommending you do not Attend due to the risk of exposure to Covid-19.

We don’t refund where You are worried about catching Covid-19 or where Your travel plans are affected by Covid-19 restrictions.
